What is software licence actually?

Computer programs are protected by copyright law which declares that such products cannot be copied or installed without the permission of the copyright owner. The software licence enables you to use the software. You only have the right to use the software and not the software itself. The software products of many manufacturers (Microsoft, Symantec, CA, Citrix, McAfee, etc.) have a licence which you can buy in three basic ways:

• a software product in a box with a CD
• with a software product installed on a new computer
• as a volume license when you buy at least five licences at the same time
  

Volume licensing provides the opportunity to buy the right of using a software product forever or for a definite time span.

Why is it necessary to care about legal software use and check the origin of the software?

Company managers who commit copyright law infringement can be sentenced to 5 years in prison in case of causing especially big financial disadvantage; and to 2-8 years in prison in case of causing especially serious financial disadvantage.

In Hungary companies use almost every second software product illegally. To put it in other words, the companies do not have the necessary software licences.

What is End-User License Agreement (EULA)?

The End-User License Agreement (EULA) is the contract between the user and the manufacturer of the software product (or the equipment on which the software was previously installed).

The EULA contains the rights related to the use of the software product. It may prescribe what sort of modifications you are allowed to make on the software:

• It may put a restriction on the number of copies the user can make
• It may allow the user to install the software on another computer or load it onto a portable device
• It may restrict the use of software updates and previous versions
• It may also give rights related to the use of networks.

The rights and restrictions contained in the volume license may differ from the ones contained in the EULA. In such cases the regulations of the volume licence are relevant. If the End-User License Agreement cannot be accessed on the computer, the EULA in the software packaging is the relevant version.

Is it important to read the EULA?

To use a software product, you have to accept the EULA (however, this alone does not prove the legal use of the software). It is recommended to read the EULA thoroughly in order to understand the rights and obligations it contains. For example, it is a frequent mistake that users think they can copy the product, whereas in reality they are not allowed to do that. This, the end-user software copying is one of the most frequent form of software piracy.
